N/a’an ku sê Wildlife Experience (Pty) Ltd (“NWE") Waiver, Indemnity, and Assumption of Risk Form

I acknowledge that I must read and sign a Waiver, Indemnity, and Assumption of Risk form upon my arrival in Namibia for my activities with NWE. By paying a deposit, I agree to the Booking Terms and Conditions outlined by NWE and understand that this deposit confirms my arrangements and booking. I recognise it is my responsibility to ensure that passports, visas, travel permits, health certificates, inoculations, and other required documentation are obtained, current, and in order.


NWE also strongly recommends that I obtain the following types of insurance, which I understand are commercially available:


  • Accidental death and disability

  • Major Medical

  • Trip cancellation

  • Emergency Medical Evacuation

  • Theft or Loss of Personal Effects


I am aware that adventure travel, whether in civilised or remote areas, by plane, train, automobile, boat, horseback, other conveyance, or on foot, carries inherent risks of illness, injury, disability, death, or loss and damage of property, which may be caused by the negligence of others, natural forces, and other known and unknown causes.


I fully understand and acknowledged that NWE is based in a wildlife area. Despite all safety precautions, there are many obvious and subtle risks and intrinsic dangers always present


in such an environment. I recognise that such risks and inherent dangers include but are not limited to, the propensity of wild animals to behave in ways which may result in injury, harm, or death to persons around them. I also recognise the latent dangers present in all types of equipment, fencing, obstacles, tools, vehicles, and machinery used in NWE's activities and/or in and around its property, the fact that there may be a negligent act or omission, whether or not in combination with any of the above risks, by any employee or representative of NWE. I understand that such risks or intrinsic dangers may cause or result in severe injury or death.


I also understand the risks involved in volunteer activities, visiting activities, hotel lodging and accommodations, or employment/associative tasks, the harshness of wilderness habitats, and the forces of nature, all of which are beyond the control of NWE. I recognise that such risks may be present at any time before, during, and after the trip.


I recognise that NWE may purchase or rent outfitting services, transportation services, hotel lodging and accommodations, restaurant services, and other services from various independent contractors and suppliers not subject to its control. Therefore, NWE cannot be liable for any death, personal injury, disability, property damage, or other loss that may occur due to any act or omission of such contractors or suppliers. I am also aware that medical services or facilities may not be readily available during the time spent at NWE.



In consideration of the aforesaid, I, the undersigned, hereby:


  1. Acknowledge that I am entering a wildlife area for volunteer activities, hotel lodging and accommodations, or employment/associative tasks, traveling over uneven and potentially hazardous terrain, staying in an unfenced camp, and may come into close contact with wild and dangerous animals.

  2. Acknowledge that my activities, including all travel to, from, and within the wildlife or concession area, and the activities conducted, are entirely at my own risk.

  3. Release and indemnify NWE, its employees, agents, and associates from all liability and waive all claims, of any nature, which may arise from any cause during my activities, including all travel to, from, and within the wildlife or concession area.

  4. Indemnify and agree to hold harmless NWE, its employees, agents, and associates against all claims of any nature during my activities, including all travel to, from, and within any wildlife or concession area, which any of my dependents or any third party may have, including, but not limited to, claims arising from my death, disability, personal injury, or loss or damage to my possessions.

  5. Agree to adhere to all rules and regulations brought to my attention during my activities by the management, guides, or any other employee of NWE.

  6. Acknowledge that NWE shall not be liable for any injury, illness, harm, loss of support, consequential loss, damage, or damages of any nature that may be sustained from any cause whatsoever during my activities, including all travel to, from, and within the wildlife and concession area.

  7. Acknowledge that a comprehensive safety talk was given to me, and all safety rules of NWE were explained in detail.

  8. Agree that any claims, be they in contract, delict, or otherwise, instituted against NWE shall be governed by the laws of Namibia and may only be instituted in a Namibian Court.

  9. Understand that this document has legal consequences and implications and have read the document and acknowledge that I am bound thereby.

  10. Expressly and voluntarily assume any and all such risks with respect to the activities and circumstances, both enumerated and not, and pledge not to sue or pursue any legal action against NWE, its employees, agents or associates on account of any losses, claims, costs, liabilities, injuries, disabilities, or damages.

  11. NWE shall not be liable for any loss or damage to the personal belongings or valuable items of guests and volunteers, including but not limited to theft, except where such items were stored in designated safes provided by NWE. In such cases, liability shall only arise if the guest or volunteer can provide conclusive evidence that the items were properly secured in the designated safe at the time of the loss. This indemnification shall apply to all areas of the premises, and guests and volunteers are encouraged to make use of the safes for their valuable belongings.

  12. Further agree not to claim the unenforceability of this Waiver and Indemnification and agree that the foregoing obligation shall be binding upon me personally, as well as my heirs, assigns, executors, administrators, and family members, and shall also be binding upon any minors accompanying me.

  13. The Parties agree to the use of electronic signatures, as provided for in section 20(2) of the Electronic Transactions Act, 4 of 2019.
